What is the SME Fund 2026?

How to obtain funds from the SME fund?

Step 1: Checking if the mark can be registered

Step 2: Grant application

We will submit an application to the EUIPO for funding on your behalf. We usually receive a decision within 15 working days.

Step 2: File a trademark application

Only after receiving a positive decision (approval), our Patent Attorney will file your trademark application with the Patent Office of Poland or the EUIPO.

Step 3: Submit a cost reimbursement request

Once the application is approved, we submit a request for the funds to be disbursed. The money will be transferred directly to your bank account.

Can I still receive funding if I reported a conflict of interest before submitting a grant application?

No. This is the most important rule of the SME Fund program. Reimbursement applies only to signs reported after receiving the decision on granting the bonus (grant). Retrospective actions are not financed.

No. The SME Fund 2026 program only reimburses official fees (to the Patent Office of the Republic of Poland or the EUIPO).
The fee for the work of a patent attorney (trademark search, preparation of documentation, supervision of the case) is a cost that the entrepreneur covers independently.

The total cost of registering a trademark with SME Fund 2026 funding depends on the number of classes of goods and services for which the trademark is being registered. The fee for each class depends on the rates applicable in the selected office. In the Patent Office of the Republic of Poland, the fee for registering a trademark in the first class is PLN 890, and in EUIPO, the cost of registering a trademark in the first class is EUR 800. In addition to this calculated cost, the fees of the law firm must also be added. The cost of submitting an application for funding, together with the costs of registering the trademark, ranges from PLN 600 to PLN 5,000 and depends on the client’s involvement and the amount of work performed by the law firm.

Yes. You can choose to protect your trademark only in Poland (through the UPRP) or throughout the European Union (through the EUIPO). In both cases, you are entitled to a refund of 75% of the application fees.

Yes, this applies to application fees. The refund covers the costs incurred for filing a trademark application, not the fact of its successful registration. However, to avoid “throwing money away” (even grant money), we always recommend conducting a prior registrability search, which we perform at our law firm.

EUIPO operates efficiently. Typically, the transfer (refund) takes place within 30 days of the payment request being approved.

Yes. The fund operates on a “first come, first served” basis. Although the program is planned for the entire year, funds may run out earlier. It is worth submitting an application at the beginning of the year.

Yes. Each edition of the SME Fund is treated separately. Even if you have used grants in previous years, you can apply for new funds for new trademark applications in 2026.

The program allows you to apply for one grant per year for each of your businesses. There are no restrictions on the number of trademarks or designs for which you can use the grant. This means that you can choose to register several trademarks under one grant, making full use of the available amount of 700 EUR.

Funding under the SME Fund program does not cover all costs related to trademark protection. In particular, the following costs are not eligible for reimbursement:

  • costs related to the renewal of trademark protection,
  • fees for the registration of an international trademark if it covers EU countries,
  • fees for the registration of an international trademark designating the European Union,
  • attorney fees,
  • costs incurred before receiving official confirmation of the grant of funding.
If the grants you have received did not cover the same or similar activities as the SME Fund program related to the protection of intellectual property, mainly through the registration of trademarks or industrial designs, you can participate in it.

No. Receiving a grant is not dependent on the final outcome of the registration procedure. Even if the office refuses to register the trademark, there is no obligation to return the funding.
