What does TM mean?

  • “I have TM, so the brand is protected” – not necessarily, this symbol does not confirm the registration of the trademark.
  • “® I can add, because everyone does it anyway” – the ® symbol can only be used
    after the trademark is registered.

Symbols do not replace legal protection – they only signal it.

What is worth doing in practice?

If the name or logo is important for the business:

  1. check if the trademark can be registered
  2. assess the risk of conflict with other marks
  3. decide in which market you need protection
  4. only then use ® – consciously and in accordance with the law!
